Terms of Use
1. Purpose and acceptance
These Terms of Use (ToU) define the terms and conditions under which Meridian Synergy SAS (hereinafter 'the Publisher') makes available the Waypoint360 marketplace accessible at waypoint360.eu (hereinafter 'the Platform').
Accessing and using the Platform implies full and unreserved acceptance of these ToU. Any natural or legal person (hereinafter 'the User') who creates an account or accesses the Platform is deemed to have accepted these ToU.
2. Service description
Waypoint360 is a marketplace connecting clients with certified professional drone operators. It enables:
- Search and connection with DGAC-certified drone operators carrying professional liability insurance
- Viewing operator profiles: certifications, specialties and coverage areas
- Requesting online quotes for professional drone missions
- Access to the Waypoint360 management platform for registered operators (fleet, missions, DGAC compliance)
3. Account access
Access to the Platform is open to professionals (legal entities or individuals engaged in a professional activity). The User creates an account by providing a valid email address and a secure password.
The User is responsible for the confidentiality of their credentials and for any activity carried out under their account. In the event of a compromised account, they must immediately notify the Publisher at legal@meridian-synergy.com.
The Publisher reserves the right to suspend or terminate any account whose use is contrary to these ToU, applicable regulations, or likely to infringe the rights of third parties.
4. User obligations
The User agrees to:
- Provide accurate and up-to-date information when creating an account and throughout use of the service
- Use the Platform in compliance with applicable legal and regulatory requirements for drone operations (EU Regulation 2019/947, DGAC orders, EASA regulations)
- Not attempt to bypass, hack or alter the Platform's security systems
- Not use the Platform for unlawful or public-order-contrary purposes
- Ensure that flight and compliance data recorded on the Platform accurately reflects reality
5. Personal data (GDPR)
The Publisher processes Users' personal data as data controller, in accordance with the General Data Protection Regulation (GDPR — EU 2016/679) and the French Data Protection Act.
Data collected (name, professional email address, operator profile information) is hosted within the European Union via Supabase (AWS eu-west-3, Paris). It is not transferred to third parties for commercial purposes.
In accordance with the GDPR, Users have the right to access, rectify, erase, port and object to the processing of their data, exercisable by contacting legal@meridian-synergy.com.
6. Intellectual property
The Waypoint360 Platform, its source code, interfaces, algorithms and content (excluding data entered by the User) are the exclusive property of Meridian Synergy SAS and are protected by intellectual property law. Any unauthorised reproduction, modification or exploitation is prohibited.
The User retains ownership of the data they enter on the Platform. They grant the Publisher a non-exclusive, non-transferable licence to host, process and display such data solely for the purpose of providing the service.
7. Limitation of liability
Waypoint360 is provided 'as is'. The Publisher strives to ensure continuity and quality of service but does not guarantee uninterrupted availability. The Publisher cannot be held liable for indirect damages, data loss or business losses resulting from a service interruption.
Waypoint360 is a marketplace platform. The Publisher cannot be held liable for the quality of services performed by registered operators. The User (client or operator) remains solely responsible for compliance with applicable regulatory obligations.
8. Amendments to ToU
The Publisher reserves the right to modify these ToU at any time. Users will be informed of any material change by email or in-app notification at least 30 days before the new terms take effect. Continued use of Waypoint360 after that period constitutes acceptance of the updated ToU.
9. Governing law and jurisdiction
These ToU are governed by French law. In the event of a dispute regarding their interpretation or performance, the parties will endeavour to find an amicable solution.
In the absence of an amicable agreement within 30 days, any dispute shall be submitted to the exclusive jurisdiction of the Paris courts, notwithstanding multiple defendants or warranty claims.
